II - Australia’s AI Healthcare Policy Vacuum: Risks, Privacy, and Missed Opportunities

In Part 1, we examined the imbalance created when patients use AI tools like ChatGPT while doctors are banned from doing the same. That imbalance exists in part because Australia has no coherent national policy for AI in healthcare. The Department of Health has issued no definitive guidance, leaving health services to improvise or, more often, to prohibit AI use altogether.

The result is uneven access, uncertain governance, and a growing risk that both patients and clinicians will use AI without adequate safeguards.

Why a Policy Vacuum is Dangerous

In emergency medicine, delay can be deadly. So can misdirection. Without national standards, individual hospitals make inconsistent decisions about whether clinicians can use AI scribes, decision-support tools, or patient-facing AI platforms. The absence of policy has led some networks to ban AI entirely, even for administrative functions, while others permit pilot projects without clear accountability.

This is not just a governance gap; it is a patient safety issue. AI is already in the consultation room via the patient’s phone. If doctors cannot access comparable tools, they are debating in the dark against AI-generated conclusions they cannot interrogate.

The Privacy Problem

When patients paste their pathology results, imaging reports, or discharge summaries into ChatGPT or other AI tools, they may be exposing sensitive health information to third parties. Some platforms log these inputs, potentially storing them on servers outside Australia.

Without a national framework, patients have no clear protection, and clinicians have no mandate to warn them. This is an odd inversion of medical privacy norms: hospitals are bound by strict confidentiality rules, yet patients are free to share their most personal data with unknown algorithms.

Lessons from Abroad

  • United Kingdom (NHS): The NHS has cautiously approved eight AI scribes for limited use, subject to strict evaluation and safety monitoring. This offers a model for phased, controlled adoption rather than blanket prohibition.

  • United States: Several health networks are running AI scribe pilots with defined success metrics, particularly in primary care and emergency settings. Privacy safeguards are embedded from the start.

  • Singapore: A national AI governance framework specifies standards for clinical validation, patient consent, and security before deployment, ensuring alignment across public and private sectors.

These examples show that AI integration can be both safe and structured, but only if driven by policy rather than fear.

The Case for AI Scribes in Australia

AI scribes are an instructive test case. They promise to cut documentation time, reduce burnout, and improve patient interaction by freeing clinicians from the keyboard. Yet in many Australian hospitals, they are banned outright, often without trial. This is short-sighted.

By contrast, NHS pilots require rigorous oversight, clinician training, and real-world evaluation before scaling up. This approach not only protects patients but also builds a shared evidence base for what works.
